1. Acceptance of these terms

These Terms & Conditions ("Terms") form a binding agreement between you and Visatech S.R.L., a company incorporated under the laws of Italy with registered office at Via del Lauro 9, Milan, Italy, 20121 ("Visatech", "we", "us"). By downloading, installing, or using the Decluttr AI mobile application (the "App") or by using the decluttrai.com website (the "Site"), you accept these Terms in full. If you do not accept them, do not use the App or the Site.

2. Definitions

  • App: the Decluttr AI mobile application for iOS and Android.
  • Service: the App, the Site, and any related features we make available.
  • Pro: the paid tier of the App, available via Weekly subscription, Yearly subscription, or Lifetime purchase.
  • Subscription: a recurring purchase managed by Apple or Google.

3. Licence

Subject to your compliance with these Terms, Visatech grants you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, solely for your personal, non-commercial use.

4. No account required

The App does not require you to create an account, provide an email address, or sign in. Your entitlements (Free or Pro) are tied to an anonymous device identifier that is mirrored across your devices via Apple iCloud Key-Value Store or Google Play account linking.

5. Subscriptions and pricing

The App is available at the following tiers:

  • Free: full scanning of your photo library, up to 500 MB of cumulative cleanup, plus unlimited calendar cleanup. No cost.
  • Pro Weekly: US$6.99 per week, with a 3-day free trial for new subscribers.
  • Pro Yearly: US$39.99 per year, with a 3-day free trial for new subscribers.
  • Lifetime: US$69.99, a one-time non-recurring purchase.

Prices listed are in US dollars and may differ in your local currency or region. The price displayed by the Apple App Store or Google Play at the moment of purchase is the authoritative price you will be charged. Where intro free trials are not eligible in your region, the App will disclose this before purchase.

6. Auto-renewal disclosure (Apple App Store and Google Play)

The following disclosures apply to Pro Weekly and Pro Yearly subscriptions:

  • Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
  • Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the price of the subscription you selected.
  • You can manage and cancel your subscriptions in your App Store account settings (iOS) or Google Play account settings (Android).
  • Any unused portion of a free trial period is forfeited when you purchase a paid subscription where applicable.

7. Refunds

All purchases of the App and of Pro are processed by Apple or Google. Refund requests are handled by Apple and Google under their respective policies. You may request a refund here:

8. EU 14-day right of withdrawal

Pursuant to Articles 52 and 59 of the Italian Consumer Code (Legislative Decree 206/2005) implementing Directive 2011/83/EU, you ordinarily have 14 days to withdraw from a contract for digital content concluded at a distance. By starting your Pro Weekly or Pro Yearly subscription, or by activating your 3-day free trial, you expressly consent to the immediate execution of the contract and you acknowledge that the 14-day right of withdrawal is forfeited (Art. 59(1)(o) of the Consumer Code). You may still cancel the next renewal at any time through your App Store or Google Play account settings.

9. Acceptable use

You agree that you will not:

  • Reverse engineer, decompile, or attempt to derive the source code of the App, except to the extent expressly permitted by mandatory law.
  • Circumvent or attempt to circumvent the Free-tier limits, the entitlements system, or any other technical measure used by Visatech.
  • Use the App or the Site in any way that violates applicable laws or third-party rights.
  • Use automated systems, scripts, or bots to interact with the Service.

10. User content

The App processes your photos, contacts, and calendar entries entirely on your device. Visatech does not host or upload any of your content. You retain all rights in your content, and Visatech makes no claim to it.

11. Intellectual property

The App, the Site, and all related intellectual property, including but not limited to source code, design, trademarks, logos, illustrations, copy, and documentation, are owned by Visatech S.R.L. or its licensors and are protected by Italian, EU, and international copyright, trademark, and other applicable laws. Nothing in these Terms grants you any right in or to Visatech's intellectual property other than the limited licence in Section 3.

12. Disclaimers

The App and the Site are provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In particular and without limitation:

  • We do not guarantee a specific amount of storage that will be reclaimed in any session, the result depends on the contents of your device.
  • No iOS app can clean other apps' caches or system files. Decluttr AI helps you reclaim space within your photo library, large videos, screen recordings, screenshots, contacts and calendar, the categories Apple actually permits a third-party app to access.
  • Decluttr AI's duplicate, blur, and similarity detection is highly accurate but not perfect. Always review proposed deletions before confirming them.

13. Limitation of liability

To the maximum extent permitted by applicable law, Visatech's total aggregate liability arising out of or in connection with your use of the Service is limited to the amount you paid to Apple or Google for the App in the twelve (12) months preceding the event giving rise to the claim.

Visatech will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data. You acknowledge that you are responsible for verifying which items to delete before confirming deletion. As an additional safeguard, when you compress a media file, Decluttr AI keeps the original archived in a "Decluttr Originals" album for 30 days so that you can restore it.

Nothing in these Terms excludes or limits liability for fraud, gross negligence, or any other liability that cannot be excluded or limited under applicable law, including under the Italian Consumer Code.

14. Indemnity

You agree to indemnify and hold Visatech harmless from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of your breach of these Terms or your misuse of the Service, except to the extent caused by Visatech.

15. Termination

You may stop using the App and the Site at any time. Visatech may suspend or terminate your access to the Service if you materially breach these Terms, with reasonable prior notice where practicable.

16. Changes to these Terms

We may update these Terms from time to time. We will announce material changes in the App's release notes or on this page. Continued use of the Service after such changes constitutes your acceptance of the updated Terms. The "Last updated" date at the top of this page indicates the most recent revision.

17. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Italy, without regard to its conflict-of-law rules. The Courts of Milan, Italy shall have exclusive jurisdiction over any disputes arising from or in connection with these Terms, subject to any mandatory protections available to consumers under the law of their place of residence (in particular, under Article 18 of EU Regulation 1215/2012).

18. Dispute resolution and ODR

If you are a consumer residing in the European Union, you have the right to bring a complaint through the European Commission's Online Dispute Resolution (ODR) platform, available at ec.europa.eu/consumers/odr.

19. Apple App Store terms (addendum)

If you obtained the App from the Apple App Store, the following additional terms apply (Apple's required schedule):

  • These Terms are concluded between you and Visatech only, and not with Apple Inc. Visatech, not Apple, is solely responsible for the App and its content.
  • The licence in Section 3 is further limited to use on Apple-branded products that you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to provide any maintenance or support services with respect to the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
  • Visatech, not Apple, is responsible for addressing any claims you or any third party may have relating to the App or to your possession and use of the App, including product liability, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
  • In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Visatech, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
  • You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

20. Google Play terms

If you obtained the App from Google Play, your use is also subject to Google Play Terms of Service and Google Play Billing Policies. In the event of any conflict between these Terms and Google's terms with respect to your use of the App through Google Play, Google's terms shall govern that subject matter.
